Florida has sued TikTok, accusing the social media platform of violating the state’s child safety law by permitting underage users to access its services and exposing minors to potentially harmful content.

Florida Attorney General James Uthmeier filed the lawsuit, claiming that TikTok has not complied with legislation that was created to limit children’s access to social media and improve parental controls, according to reports.

Alleged Breach of Age Restrictions:

The lawsuit centers on a Florida law that bans children under 14 from setting up social media accounts and requires parental consent for those 14 and 15.

The state says TikTok is still allowing users under the age of consent to sign up and use the app, despite a law that limits how old you have to be to use the service – allowing minors to circumvent age verification requirements.

The complaint alleges the company has not done enough to keep children from accessing its services.

Concerns Over Harmful Content

Florida's lawsuit also alleges that TikTok has misrepresented the nature of content available on the platform to parents and guardians.

According to the complaint, the platform understates the risk of young users being exposed to harmful or inappropriate material, including violent and other potentially damaging content.

The state is seeking a court order compelling TikTok to comply fully with the law, along with financial penalties and damages.

TikTok Responds

TikTok said in a statement it has been working with state authorities and has already started notifying Florida users under 14 about account suspensions as part of its response to the lawsuit.

The company said it was reviewing the legal complaint and evaluating how to respond to the allegations.

TikTok has previously stated it provides a variety of safety tools and parental controls intended to safeguard younger users.
